S. was charged with conspiring to traffic cocaine at the 10+ kilogram level. The Crown had been seeking a lengthy penitentiary sentence if S. was convicted. At trial, the Crown relied on evidence of conversations recorded by a wire-wearing police informant. Following numerous constitutional applications and a six week trial at the Superior Court of Justice, all charges were stayed.

Successful Result: All charges were stayed.
Conspiracy to traffic cocaine
L. was charged with the possession of two kilograms of cocaine for the purpose of trafficking. The cocaine had been found in a car associated to L., parked in the parking garage of his building. Prior to trial, the defence brought an application seeking a stay of proceedings due to the Crown’s failure to preserve the building’s video surveillance footage. All charges were stayed.

Successful Result: All charges were stayed.
Possession of cocaine for the purpose of trafficking
Z. was charged with possession of fentanyl and cocaine for the purpose of trafficking. The evidence was discovered in the course of a traffic stop, during which Z. was taken from his car and searched. At trial, the defence brought an application exclude the seized drugs, arguing that Z.’s constitutional rights were breached. All charges were stayed.

Successful Result: All charges were stayed.
Possession of cocaine and fentanyl for the purpose of trafficking
O. was charged with the production of marijuana for a 1000+ plant indoor grow operation. At trial, the defence challenged the validity of the search warrants, as well as raising issues related to the handling of critical evidence. All charges were stayed.

ABOUT THE POSITION

We are an established family law firm that concentrates on all aspects of marital law, with a real focus on divorce.  We have an experienced administrative team to support you with paralegal and legal assistant services.  We’re also growing, which means over time there will be room for upward mobility.  Our main office is located in beautiful downtown Kennebunk, and a satellite office is located in Portland.  As we continue to grow, we anticipate opening a permanent 2nd office to house our entire family team.

We are looking for someone who would consider themselves not only an experienced litigator, but a seasoned negotiator as well.  Family law is as much about compromise and client management as it is about duking it out in the courtroom.  However, if you haven’t litigated numerous final contested hearings, contested interim hearings, protection orders, conducted extensive financial discovery, including depositions, please do not apply.  This position just isn’t for you.  If you don’t like talking with clients and taking phone calls, this position isn’t a fit for you.  If you consider what you do is a job rather than a professional calling, this Firm isn’t for you.

ABOUT YOU

You are an experienced family law litigator if…

  • You have taken divorce cases to final contested hearings where the other party was represented by counsel.
  • You have worked with expert witnesses and conducted hearings on the issues of financial misconduct, complex business and personal financial asset distribution, and issues concerning spousal support.
  • You have conducted depositions.
  • You have conducted emergency interim hearings on the issues of spousal support and/or child support.
  • You have conducted final contested protection from abuse hearings where the other party was represented by counsel.
  • You thrive in high leverage / high stress situations.
  • While you won’t need to, you have the ability and experience to draft and conduct financial discovery on your own, including appropriate interrogatories, requests for production of documents, requests for admissions, etc.

While we care about skills and experience, we care equally about the cultural fit between you and our Firm.  The right person for this role must:

  • Be able to thrive in the chaos of emergencies, not just survive.  Sometimes the best laid plans fall apart and you must have the mindset to pivot and make lemonade out of lemons.
  • Focus on the solution, not the problem.
  • Have a thick skin, don’t take things personally.
  • Have a high degree of emotional intelligence.
  • Have keen conflict resolution skills (NOT conflict avoidance skills).
  • Want to work in a structured office environment.  While there is the opportunity to work remotely, this is not a remote position as our Firm culture is dependent on our team working comfortably with each other in person.
  • Be excited about having some real degree of control over the litigation strategies employed on behalf of our clients.
  • Want to be managed and challenged to grow both professionally, and personally.  Because we believe professional growth is always preceded by personal growth.
